The IfSG of 2001 clearly defines the terms and leaves no doubt that there is a difference in the treatment of protective vaccinations and vaccinations. It even defines when liability is assumed for a vaccination. Second, the right to integrity is a fundamental human right, even for stateless persons with identity cards administered by the Federal Republic (Article 27, Convention on the Status of Stateless Persons - Statelessness Convention), this right has been included in the Basic Law, Article 2 (2).

(2) Everyone has the right to life and physical integrity. The freedom of a person is inviolable. These rights may only be interfered with on the basis of a law.

Infection Protection Act v. 2001

§ 2 Definitions

For the purposes of this law is

...
...

...
...

My comment:

"ACHTUNG in 11. Impfschaden nur durch eine SCHUTZIMPFUNG."

§ 20 Vaccinations and other measures of specific prophylaxis

(1) The competent upper federal authority, the highest state health authorities and the bodies commissioned by them as well as the health authorities inform the population about the importance of vaccinations and other measures of specific prophylaxis of communicable diseases.

...

(3) The highest state health authorities should make public recommendations for vaccinations or other measures of specific prophylaxis on the basis of the respective recommendations of the Standing Vaccination Commission.

...

(7) As long as the Federal Ministry of Health does not make use of the authorization under paragraph 6, the state governments are authorized to issue a statutory ordinance under paragraph 6. The state governments can transfer the authorization to the highest state health authorities by ordinance. The basic right to physical integrity (Article 2, Paragraph 2, Clause 1 of the Basic Law) can be restricted in this respect.

My comment:

Section 21 Vaccines

In the case of a protective vaccination ordered on the basis of this law or a vaccination publicly recommended by the highest state health authority or a vaccination according to Section 17 Paragraph 4 of the Soldiers Act, vaccines may be used that contain microorganisms that can be excreted by the vaccinated and ingested by other people. The basic right to physical integrity (Article 2, Paragraph 2, Clause 1 of the Basic Law) is restricted in this respect.

My comment:

"Da haben wir eine Unterscheidung von Schutzimpfung oder einer Impfung..."

§ 11 Transfers by the health department and the competent state authority

...

(3) The suspicion of damage to health that goes beyond the usual extent of a vaccination reaction reported to the health department in accordance with Section 6 (1) No. 3, as well as the case reported to the health department in which there is a suspicion that a drug is the source of infection, shall be made by the health department immediately to the competent state authority and to the respective higher federal authority in accordance with § 77 Medicinal Products Act. The transmission must, as far as can be determined, contain all necessary information, such as the name of the product, name or company of the pharmaceutical company and the batch number, in the case of vaccinations, the time of vaccination and the start of the disease. Only the date of birth, gender and the first letter of the first name and the first letter of the first surname must be given for the reported patient. The competent higher federal authority makes the transmissions available to the Robert Koch Institute within one week for an epidemiological analysis of the infection. Paragraph 1 remains unaffected.

My comment:

"Ups, warum muß man bestimmte Daten für Impfungen explizit angeben??? Ja wegen der Haftung..., schauen wir mal..."

Section 60 Care in the event of vaccination damage and damage to health through other measures of specific prophylaxis

...

(2) Care within the meaning of paragraph 1 is also given to anyone who, as a German outside the scope of this Act, has suffered vaccination damage through a vaccination, for which he or she is subject to the Vaccination Act of April 8, 1874 in the Federal Law Gazette Part III, structure number 2126- 5, published corrected version, would have been obliged to stay within the scope of this Act. Care is only granted if the injured party

  1. could not be vaccinated within the scope of this Act,
  2. has been vaccinated by a doctor and
  3. at the time of the vaccination lived in the same household with a parent or custodian who was not only temporarily outside the scope of this Act for professional reasons or for training at the time of the vaccination.

...

My comment:

Anyone who, as a German outside the scope of this law, has suffered vaccination damage through a VACCINATION will receive care?

"So nun haben wir es schriftlich, im Gesetz verankert wann man für Impfungen Haftet und wann nicht..."

I can't help anyone who still has doubts. I've said that so many times and explained that there can be no vaccinations, only different rules apply to vaccinations and liability would also be assumed for them. Vaccinations, on the other hand, are voluntary and require consent, and then the person who consented is liable. Source: FB, K. Schmidt
