The 2 + 4 treaty deals with the post-war period from 1945 in connection with the term: Germany. That is why, as you can see, the Allies defined the area here Germany with the German Reich in 1937, so see picture they mean the 3rd Reich.
That means, we take a closer look at the 2 + 4 treaty and each time we use the term: “Germany” we use the correct term: “3rd Reich”. For this we have to understand that the Allies opposed the administration in 1945: “3rd Reich” . Reich "won the upper hand and occupied it, then in a row in 2 administrations = GDR and FRG as administrations for the 3rd Reich, since the 3rd Reich administration experienced a suspension through the occupation = suspension of its legal norms and freedom of action . This suspension resulted in the introduction of partly new legal norms in both the GDR and the FRG. This continued until 1990.
In 1990 the former "enemies" of the 3rd Reich administration, which they had occupied in 1945, decided to suspend their own occupation statutes = suspension = suspension for a certain period of time, although it can be proven that they did not suspend everything in the 1990 transfer agreement. This was due to the fact that no peace treaty was made in 1990, which would have meant that the state before the occupation would have fully come into force again, i.e. the 3rd Reich administration with all its old state at the time 1 day before the occupation. This would also have meant the end of the occupation and the end of the suspension = suspension of the rights of the 3rd Reich. But as one can clearly read on the front sheet, there is nothing about termination, but about suspension, which can only be done from a suspension.
This means that in 1990 the partial administration of the GDR was ended, the two parts of the 3rd Reich were reunited, the occupation statutes from 1945 - 1990 were for the most part abrogated with reservations, thus giving the 3rd Reich some room for maneuver again. At the same time, since the occupiers >>>> only suspended their rights with reservations <<<< the borders of the 3rd Reich administration were redefined. The third Reich remains as a legal entity, but with the limits of 3.
You will not believe?? Then go through the treaty and insert wherever the term Germany was used, instead of the term that the Allies really meant = German Reich as it was in 1937 (3rd Reich). And wherever there is talk of the whole of Germany, or Germany as a whole, there is a 3rd Reich within the borders of 1990 = reunified 3rd Reich.
That is not enough proof for you either? Then take a look which seals were always sealed on the German side !!! Is that the eagle of the German Reich (6 feathers per side) or that of the 3rd Reich (7 feathers per side) ?????
But come on, I'll put two more proofs on top: Take a look at the seal and national coat of arms of the French government and tell me whether there is a Faschia to be seen? Did fascists make contracts together in 1990 and reactivate the 3rd Reich ????
Now let's take a look at the text of the 2nd Federal Reorganization Act:
§3 Consequences of the cancellation
Rights and obligations which have been established or established by legislative, judicial or administrative measures by the occupation authorities or on the basis of such measures remain in accordance with Article 2, Paragraph 1 of the first transition agreement.
The repeal neither restores previous legal status nor justifies resumption, withdrawal or revocation ...... Well, that's exactly what happens when you only suspend your own rights (with reservations) and not terminated by a peace treaty.
So we hold on to it, in 1990 they reactivated the 1945rd Reich administration, which had been racked up in 3, with reservations, but did not reintroduce the old legal norms and transfer the administration of the 3rd Reich to the FRG administration.
