The Bavarian VGH made a strange decision there. He rejected an application from a clothing store, which was directed against the "2G rule" for such shops in Bavaria, as inadmissible. As a justification, the VGH stated that the applicant lacked the power to apply because clothing stores would in any case be regarded as everyday items within the meaning of the regulation, even if they were not expressly mentioned as such there. Quotation: "It also includes those [shops] that are relatively seldom and usually visited for specific reasons (e.g. opticians, hearing care professionals, hardware stores and Christmas tree sales), as well as those that are clearly not to be assigned to basic and acute care ( Bookstores, florists and garden centers). The catalog of shops for daily needs is also expressly a non-exhaustive list (“in particular”). Against this background, the concept of shops that "cover daily needs" should be understood in such a way that clothing shops also fall under the exception to the 2G regulation, because their meaning for the general public does not lag behind that of shoes, books, Cut flowers or garden tools step back and the need for clothing can arise every day. This is absolutely curious: while clothing stores have been using the "2G rule" for weeks in the belief that they have to enforce it, the VGH has now determined that this was not even necessary for clothing stores. Even more: the applicant even loses the procedure and has to bear the costs. What an incredible arrogance of the judiciary telling the applicant and all other clothing store owners with this decision that they should have done better research. But woe betide there had been controls by law enforcement officers, who of course would have imposed fines. Corresponding fine proceedings must of course be discontinued after this decision. And there may be claims for damages against the state of Bavaria.
